Terms and Conditions

These Terms and Conditions explain how Just Graphic Designs (“JGD”, “we”, “us” or “our”) provides creative, website, consulting and related services. By using this website, requesting a quotation or accepting a proposal from us, you agree to these terms together with the terms stated in the applicable quotation, proposal or service order.

1. Our services

We provide graphic design, branding, website design and development, digital services, business consultation and related creative services. We may also arrange hosting, domain registration or other services supplied by third parties. The exact scope, deliverables, price and timing for a project will be set out in the written quotation or proposal accepted by the client.

2. Quotations and acceptance

Quotations are valid for the period stated on them. A project begins only after the client accepts the quotation, supplies the information we need and pays any required deposit. If the scope changes, we may provide a revised quotation or charge separately for additional work. Prices are stated in South African rand unless we say otherwise. Any applicable tax will be shown where required.

3. Client responsibilities

The client must provide complete and accurate instructions, content, images, access details and approvals within a reasonable time. The client confirms that they own, license or have permission to use all material supplied to us. The client is responsible for checking names, spelling, dates, prices, contact details and other factual information before final approval. Delays in feedback or materials may affect the delivery date.

4. Project process, revisions and approval

We will follow the process and revision allowance described in the quotation. Requests outside the agreed scope or revision allowance may require an additional fee and extra time. Approval may be given by email, message or through another agreed channel. Once final approval is received, later changes are treated as new work. For print work, the client must approve the final proof before production.

5. Payments

Deposits, instalments and payment dates are stated in the quotation or invoice. Unless otherwise agreed in writing, final files, website handover or launch may be withheld until the full amount due has been paid. Overdue work may be paused. Third-party costs such as printing, stock assets, software, domains or hosting may need to be paid in advance and may be non-refundable once ordered.

6. Hosting, domains and third-party services

Hosting, domain names, payment gateways, plugins, software, email platforms and other third-party services are subject to their own providers’ terms, availability and renewal fees. We cannot guarantee that an external service will always be uninterrupted or error-free. The client is responsible for renewing services registered in their name unless a written managed-service agreement says otherwise. A domain name remains subject to registry and registrar rules and is not owned merely because it is available at the time of a search.

7. Intellectual property

The client retains rights in material they supplied. Ownership or licence rights in final deliverables will be as stated in the accepted quotation and take effect only after full payment. Our pre-existing tools, methods, templates, working files, unused concepts and licensed third-party assets remain ours or their respective owners. Fonts, photographs, plugins and stock assets may be subject to separate licence conditions. Unless confidentiality has been agreed in writing, we may display completed work in our portfolio and marketing as an example of our services.

8. Acceptable use

You may not use our website or services for unlawful, fraudulent, harmful, defamatory or rights-infringing activity. You may not attempt to interfere with the website, its security or another person’s access. We may refuse or stop work that would breach the law, third-party rights or reasonable professional standards.

9. Website information and third-party links

We aim to keep the information on this website accurate, but service descriptions, prices, availability and examples may change. Website content is general information and is not professional legal, financial or tax advice. Links to third-party websites are provided for convenience; we do not control or endorse all content, security or practices on those sites.

10. Warranties and liability

We will provide our services with reasonable care and skill. Results can depend on the client’s instructions, market conditions and third-party platforms, so we do not guarantee a particular level of sales, traffic, rankings or business performance. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data or interruptions caused by third-party services. Our total liability relating to an affected service will not exceed the amount the client paid us for that service. Nothing in these terms excludes a right or liability that cannot legally be excluded under South African law.

11. Suspension and termination

Either party may end a project in accordance with the accepted quotation or by written notice where no specific rule is stated. We may suspend or terminate work for non-payment, unlawful use, abusive conduct or a serious breach of these terms. The client remains responsible for work completed and committed third-party costs up to the termination date.

12. Privacy

Our handling of personal information is described in our Privacy Policy and Cookie Policy.

13. Governing law

These terms are governed by the laws of the Republic of South Africa. The parties will first try to resolve a dispute in good faith. Subject to applicable consumer law, disputes may be brought before a court with jurisdiction in KwaZulu-Natal, South Africa.

14. Changes to these terms

We may update these terms when our services, legal requirements or business practices change. The updated version will be posted here with a new “Last updated” date. Terms already agreed for an active project remain subject to that project’s accepted quotation unless the parties agree otherwise.
